Bath overflow products infringed patent, jury determines

Watco Manufacturing, Independence, Missouri, has won a court case against a competitor.

On Oct. 27, in a court in the Western District of Tennessee, a jury ruled in favour of WCM Industries, Inc. and its Watco Manufacturing Division in a patent infringement case the company brought against IPS Corporation, Compton, California. Both companies sell their products in Canada.

The jury verdict found that IPS willfully infringed six patent claims across three of WCM’s patents directed to bath waste and overflow assemblies, and that all six patent claims were valid. The products that were found to infringe Watco’s patents include IPS’s original and redesigned “Classic” bath waste and overflow products sold under the AB&A brand, including those sold with IPS’s “Press-in trim kit”.
